Selling products on milanosamplesale.com is governed by these General Conditions of Sale.

These General Conditions govern the sending of order proposals by users and their acceptance by the Seller.

1. Commercial policy

The Seller carries out its e-commerce activity exclusively towards end users who have reached the age of majority and who are "consumers".

1.2
“Consumer” means any natural person acting for purposes unrelated to their business, commercial or professional activity.

1.3
The Seller reserves the right not to accept order proposals from parties other than the consumer or in case of suspicion of fraudulent or illegal activity.

Order proposals must correspond to normal consumption needs. The Seller reserves the right to monitor orders and requests for exchange of goods.

2. Conclusion of the contract

To conclude the purchase contract you will have to send an order proposal electronically following the instructions on the site.

2.2
Before the conclusion of the contract you will be provided with the relevant information:

  • essential characteristics of the products

  • total price including taxes

  • any customs duties or taxes (paid by the buyer for non-EU countries)

  • payment methods

  • delivery methods and times

  • shipping costs

  • exclusion of the right of withdrawal

  • Goods exchange policy

  • legal guarantee of conformity

The contract is concluded when the Seller sends confirmation of acceptance of the order.

2.4
The Seller may not accept incomplete or incorrect orders or in the event of unavailability of the products.

The language of the contract is Italian.

3. Products and prices

3.1
The Seller sells original branded products, coming from end of series, sample sales or liquidations.

3.2
The products are neither used nor irregular.

3.3
The images may not perfectly represent the actual product due to monitor differences.

3.4
Prices are subject to updates. In the event of an obvious material error in the price, the Seller may cancel the order and propose the correct price.

3.5
The products are equipped with an identification tag with a disposable seal.

4. Payments

4.1
Payment can be made using the methods indicated on the site.

4.2
Payment information is processed via secure systems and is not accessible to the Seller.

4.3
Any refunds may be made exclusively in the cases provided for by the legal guarantee of conformity.

5. Shipping and delivery

5.1
Shipping methods are indicated in the "Shipping" section.

5.2
Pursuant to art. 63 of the Consumer Code, the risk is transferred to the consumer at the time of delivery.

Any visible damage must be reported to the courier upon delivery.

7. Exclusion of the right of withdrawal and goods exchange policy

7.1 Exclusion of the right of withdrawal

Pursuant to art. 59 of the Legislative Decree. 206/2005 (Consumer Code), the right of withdrawal is excluded for purchases made on milanosamplesale.com.

The products on sale fall into end-of-series, sample sale or clearance categories and are offered at reduced prices.

The purchases made are therefore definitive and no refund will be given for change of mind by the Customer.

By placing an order, the Customer expressly accepts the exclusion of the right of withdrawal.

7.2 Goods exchange policy

Notwithstanding the above, the Seller can only accept requests for exchange of goods, compatibly with warehouse availability.

The Customer can request an exchange within seven (7) days of receiving the product.

The exchange is permitted exclusively for products of the same model, with variations in size and/or colour.

Only one exchange request per product is allowed.

7.3 Conditions for exchange

The exchange will only be accepted if:

  • the product is intact

  • It has not been used or washed

  • It comes complete with a disposable seal tag

  • it is returned in the original packaging

  • it is shipped within 7 days of request

Shipping costs for returns and new shipments are entirely the responsibility of the Customer.

If the requested product is not available, the exchange cannot be made and no refund will be given.

7.4 Hygiene exclusions

The change of:

  • intimate

  • swimsuits

  • stockings and tights

  • products in one size

8. Legal guarantee of conformity

The application of the legal guarantee provided for by the articles remains unchanged. 128 et seq. of the Consumer Code.

In the event of a lack of conformity, the Customer must promptly contact the Seller.

9. Privacy

Personal data is processed according to the Privacy Policy available on the site.

10. Applicable law and competent court

These Conditions are governed by Italian law.

For disputes, the Court of the consumer's place of residence or domicile will be competent or, at the consumer's choice, the Court of Milan.

11. Changes

The Seller may modify these Conditions at any time. The changes will be effective from the date of publication on the site.

12. Photographic shooting in the showroom

During the openings of the Private Rooms, photographic and video recordings may be taken for promotional purposes.
