Right of withdrawal

1. Right of withdrawal

The right of withdrawal can be exercised for contracts concluded remotely or negotiated away from business premises pursuant to art. 52 of the Consumer Code.

The right of withdrawal applies exclusively to orders placed online or, in general, to contracts concluded remotely. It does not apply to purchases made physically at points of sale, showrooms, events, pop-up stores or other physical sales spaces, unless otherwise required by law.

The Customer has the right to withdraw from the contract within fourteen (14) days from the date of receipt of the order, without having to provide any reason.

The return request must be made by accessing the User Area of the Milano Sample Sale website, available at the following address: https://milanosamplesale.com/pages/account, using the appropriate "Return Request" function.

The Customer must select the order and the product or products he intends to return, following the guided procedure available in the User Area.

If, due to proven technical problems, the "Request Return" function is not available or accessible, the Customer may promptly contact Milano Sample Sale via the channels indicated in the Contact section, indicating the order number and the product or products for which he intends to exercise the right of withdrawal.

It is understood that the burden of proving the correct and timely exercise of the right of withdrawal will be borne by the Customer.

Once the return request has been received via the User Area and the request has been confirmed by Milano Sample Sale, the Customer must deliver the product to the shipper within three (3) days of receiving the confirmation of acceptance of the return request.

It remains understood that the right of withdrawal must be exercised within fourteen (14) days from the date of receipt of the order.

2. Effects of withdrawal and refund

If the Customer withdraws from the contract in compliance with the conditions indicated in this policy, Milano Sample Sale will refund the payments received, without undue delay and in any case within fourteen (14) days from the day on which it was informed of the Customer's decision to withdraw from the contract.

The refund may be suspended until the goods are received or until the Customer demonstrates that they have sent the goods back, depending on which situation occurs first.

The refund will be made only after receipt of the product at Milano Sample Sale and after verification of the integrity of the garment, the identification tag, the disposable seal, the original packaging and any accessories or protective materials.

If the returned product is found to be used, worn, washed, damaged, altered, without an identification tag, without a disposable seal or in any case not compliant with the conditions indicated in this policy, Milano Sample Sale reserves the right not to accept the return and not to proceed with the refund.

In this case, the garment will remain available to the Customer at the Milano Sample Sale for collection. The Customer may request the return of the product, fully bearing the related shipping costs.

The refund, where due, will be made using the same payment method used by the Customer for the initial transaction, unless otherwise agreed between the parties.

The actual time for crediting or returning the sums paid depends on the payment method used and the Customer's payment institution.

3. Legal guarantee of conformity

In any case, the application of the legal guarantee of conformity provided for by the articles remains unchanged. 128 et seq. of the Consumer Code, if the product has original defects or does not conform to the order placed.

In such cases, the Customer must promptly contact the Seller at the address indicated in the Contact section, indicating the order number, the product concerned and a description of the defect or non-conformity found.

4. Goods exchange policy

In addition to the right of withdrawal, Milano Sample Sale can accept requests for exchange of goods, subject to warehouse availability.

The Customer may request the exchange no later than fourteen (14) days from the date of receipt of the order.

The exchange request must be made by accessing the User Area of the Milano Sample Sale website, available at the following address: https://milanosamplesale.com/pages/account, using the appropriate "Return Request" function and indicating the product requested as a replacement, of the same model, in a different size and/or colour.

Only one exchange request can be made for each product purchased.

Once the exchange request has been received and the availability of the replacement product has been confirmed by Milano Sample Sale, the Customer must deliver the product to be exchanged to the shipper within three (3) days of receiving the confirmation of acceptance of the exchange request.

5. Conditions for returns and exchanges

The return or exchange is considered accepted only if the following conditions are fully respected:

a) The products must not have been used, worn, washed or damaged;

b) The identification tag must still be attached to the product with the disposable seal, which constitutes an integral part of the good;

c) The products must be returned in the original packaging, including any accessories, protective materials and documentation;

d) The products forming part of the same order must be sent in a single shipment;

e) The products must be delivered to the courier within three (3) days of confirmation of acceptance of the return or exchange request by Milano Sample Sale;

f) The products must not show signs of use, alterations or decreases in value resulting from handling other than that necessary to verify their nature, characteristics and size.

Milano Sample Sale reserves the right to refuse returns or exchange requests if the product does not comply with the conditions indicated above.

In the event that the return or exchange cannot be accepted, the Customer will be contacted and the item will remain available at Milano Sample Sale for collection. The Customer may request the return of the product, fully bearing the related shipping costs.

6. Shipping costs

Shipping costs for returning the product are entirely the responsibility of the Customer.

In the case of an exchange of goods, the shipping costs for sending the replacement product are borne by Milano Sample Sale.

Only in the case of exchange of goods, Milano Sample Sale will provide a prepaid shipping label.

7. Availability of the replacement product

After receiving the exchange request, Milano Sample Sale will check the availability of the requested product.

In the event that the product selected for the exchange is not available, the exchange can be made with a product of the same amount or a higher amount.

Where the price of the product purchased is higher than the price of the product selected for the exchange, no refund will be given for the difference.

8. Specific exclusions for hygiene reasons

For hygienic and health protection reasons, the return or exchange of sealed products which are not suitable for return for hygienic or health protection reasons and which have been opened, used, tested in direct contact with the skin or deprived of their seals, hygienic packaging or protective elements after delivery is not permitted.

By way of example, the following fall into this category:

  • underwear;

  • swimsuits;

  • stockings and tights;

  • products sold in one size, where not suitable for return for hygiene or health protection reasons.

9. Identification tag

All products offered for sale by the Seller are equipped with an identification tag fixed with a disposable seal which constitutes an integral part of the goods.

The Customer is invited to try the product without removing the identification tag and the related disposable seal.

Returns will not be accepted for products for which the tag or seal has been removed, tampered with, damaged or not intact.
