EXCLUSION OF THE RIGHT OF WITHDRAWAL AND GOODS EXCHANGE POLICY

1. Exclusion of the right of withdrawal

The right of withdrawal can only be exercised for contracts concluded remotely or negotiated away from business premises pursuant to art. 52 of the Consumer Code.

However, pursuant to and for the purposes of art. 59 of the Legislative Decree. 206/2005, the right of withdrawal is excluded for purchases made on the Milano Sample Sale site.

The products on sale fall into end-of-series, sample sale or clearance categories and are offered at reduced prices. For this reason, purchases made are to be considered definitive and there will be no refund of the price paid due to customer regrets.

By placing an order on the site, the Customer declares to have read and expressly accept this exclusion of the right of withdrawal.

2. Legal guarantee of conformity

In any case, the application of the legal guarantee of conformity provided for by the articles remains unchanged. 128 et seq. of the Consumer Code, if the product has original defects or does not conform to the order placed.

In such cases the Customer must promptly contact the Seller at the address indicated in the Contact section.

3. Goods exchange policy

Notwithstanding the above, Milano Sample Sale can only accept requests for exchange of goods, subject to warehouse availability.

The Customer may request the exchange no later than seven (7) days from the date of receipt of the order.

The exchange request must be sent via written communication to the email address indicated in the Contact section, indicating:

• order number

• product received

• product requested as a replacement (same model, different size and/or colour)

Only one exchange request can be made for each product purchased.

4. Conditions for exchange

The exchange is considered accepted only if the following conditions are fully respected:

a) The products must not have been used, worn, washed or damaged;

b) The identification tag must still be attached to the product with the disposable seal, which constitutes an integral part of the good;

c) The products must be returned in the original packaging, including any accessories and documentation;

d) The products forming part of the same order must be sent in a single shipment;

e) The products must be delivered to the courier within seven (7) days of communication of the exchange request.

Milano Sample Sale reserves the right to refuse exchange requests if the product does not comply with the conditions indicated above.

5. Shipping costs

The shipping costs for returning the product and for sending the replacement product are entirely the responsibility of the Customer.

Milano Sample Sale will not provide prepaid labels or reimburse shipping costs incurred by the Customer.

6. Availability of the replacement product

After receiving the product and verifying compliance with the conditions indicated above, Milano Sample Sale will check the availability of the requested product.

If the selected product is not available, the exchange cannot be made and no refund will be given.

In this case the Customer may request the return of the product at his own expense.

7. Specific Exclusions

For hygiene and health protection reasons, the change of:

• intimate

• swimsuits

• stockings, tights

• products sold in one size

8. Identification tag

All products offered for sale by the Seller are equipped with an identification tag fixed with a disposable seal which constitutes an integral part of the goods.

Products for which the tag or seal has been removed or tampered with will not be accepted.
